Telemedicine Terms, Medical Disclaimer & Virtual Consultation Policy
This policy delineates the operational protocols, clinical boundaries, legal disclaimers, and patient obligations governing remote healthcare consultations facilitated through QwikPro's technology platforms (including QwikCare and QwikDoc), which are intended to operate in accordance with applicable laws, regulations, and professional guidelines, as applicable to the relevant independent healthcare professional and service.
CRITICAL EMERGENCY MEDICAL DISCLAIMER
TELEMEDICINE IS NOT SUITABLE FOR ACUTE MEDICAL EMERGENCIES. If you or the patient are experiencing severe chest pain, signs of stroke (facial drooping, arm weakness, speech slurring), acute shortness of breath, uncontrolled heavy bleeding, severe traumatic injuries, loss of consciousness, or acute poisoning, DO NOT ATTEMPT TO USE THIS PLATFORM FOR AN EMERGENCY CONSULTATION. Immediately dial national emergency services (112 or 108 in India) or proceed to the nearest hospital casualty/emergency room without delay.
1. Institutional Role & Absolute Medical Disclaimer
QWIKPRO PAYMENTS PRIVATE LIMITED ("QwikPro", "we", "us" or "our") is solely a technology infrastructure provider. We provide digital portals, scheduling tools, encrypted communication channels (video, audio, text), and practice management software (QwikDoc and QwikCare) that facilitate direct connections between patients and independent healthcare professionals.
Explicit Medical Clarifications:
- QwikPro is not a hospital, clinic, diagnostic center, or healthcare facility.
- QwikPro does not engage in the practice of medicine, nursing, pharmacy, or clinical care.
- No employee, developer, or representative of QwikPro is authorized to render clinical advice.
- No communication transmitted through our software by QwikPro shall be construed as medical diagnosis, treatment planning, or medical prognosis.
Any doctor-patient relationship established during a teleconsultation is created solely, directly, and exclusively between the patient and the consulting Registered Medical Practitioner (RMP).
2. Emergency Situations & Critical Care Exclusion
Telemedicine modalities rely on electronic transmission and cannot replicate the hands-on interventions, resuscitative equipment, continuous bedside monitoring, and emergency surgical capabilities of a physical medical facility.
By booking or initiating a consultation on the Platform, you explicitly acknowledge and warrant that the underlying clinical condition is non-critical, stable, and suitable for remote technological evaluation. You release QwikPro from any liability arising from attempts to utilize the Platform in place of emergency in-person medical attention.
3. Nature & Scope of Virtual Consultations
Virtual consultations may be conducted via high-definition video conferencing, real-time voice calls, or secure asynchronous messaging, supplemented by the transmission of diagnostic test reports, clinical photographs, or physiological vitals recorded in QwikCare:
- First Consultations vs. Follow-up: Subject to the applicable Telemedicine Practice Guidelines and the independent practitioner's clinical discretion, an RMP may conduct first consultations for routine ailments, triage, dietary/lifestyle counseling, or second opinions, and follow-up consultations for chronic disease management where prior in-person evaluation has occurred.
- Practitioner Verification: Medical practitioners utilizing QwikDoc are required to hold valid medical degrees and registrations with their respective State Medical Councils or the National Medical Commission (NMC) / Healthcare Professional Registry (HPR).
- Patient Verification: RMPs are mandated under law to verify the identity of the patient prior to initiating clinical discussions and may request identification verification if deemed necessary.
4. Practitioner Autonomy & In-Person Recommendations
The consulting RMP maintains total clinical autonomy and discretion at every stage of the consultation:
- Conversion to Physical Consultation: If at any juncture during a teleconsultation the RMP determines that remote information is insufficient, ambiguous, or inconclusive, the RMP is professionally obligated to advise the patient to seek an in-person physical clinical examination.
- Right to Decline: An RMP reserves the absolute professional right to terminate, refuse, or defer a teleconsultation if they assess that the clinical circumstance is not amenable to virtual care.
- Independent Clinical Judgment: QwikPro exercises zero control or influence over the clinical reasoning, diagnosis, therapy selection, or referral choices made by an RMP.
5. Inherent Limitations of Telemedicine
Patients must understand and accept the structural and clinical constraints inherent to telemedicine:
- Absence of Physical Examination: The practitioner cannot palpate organs, auscultate heart or lung sounds directly, perform percussion, check neurological reflexes, or inspect skin lesions with tactile sensation.
- Visual & Audio Limitations: Lighting discrepancies, camera angle distortions, low video resolution, background ambient noise, or microphone clipping may impair visual inspection or verbal clarity.
- Diagnostic Uncertainty: Because of remote constraints, certain illnesses may require supplemental laboratory testing or radiological imaging before a definitive diagnosis can be safely established.
6. Patient Responsibilities & Accurate Disclosures
Because the consulting practitioner cannot physically examine you, the clinical safety of the consultation rests critically upon the accuracy and completeness of your disclosures. As a patient or guardian, you agree:
- To provide full, truthful, and exhaustive disclosures regarding your symptoms, onset time, pain severity, past medical procedures, chronic conditions (e.g., diabetes, hypertension, renal impairment), and pregnancy status.
- To disclose all active medications, herbal supplements, over-the-counter preparations, and documented drug allergies (especially to antibiotics, analgesics, or anesthesia).
- To upload genuine, unmodified diagnostic reports, radiology scans, or past prescriptions into QwikCare.
- To attend the scheduled video/audio session from a quiet, well-lit, private environment free of distractions that could compromise communication.
7. Digital Prescriptions & Controlled Substances Policy
Where an RMP issues an e-prescription through the Platform, workflows are designed to support adherence to applicable provisions of the Telemedicine Practice Guidelines and relevant drug regulations, subject to practitioner compliance:
| Drug Category | Permissibility via Telemedicine | Prescription Conditions |
|---|---|---|
| List O (Over-the-counter, antacids, vitamins, paracetamol, ORS) | Permitted via any modality | Audio, video, or text consultation |
| List A (First consult medications: antibiotics, anti-hypertensives, bronchodilators) | Permitted via Video Only | Mandatory real-time video consultation |
| List B (Follow-up repeat medications for established chronic diseases) | Permitted for follow-up | Where in-person consult occurred within past 6 months |
| Prohibited Drugs (Schedule X narcotics, psychotropics, habit-forming sedatives, MTP drugs) | STRICTLY PROHIBITED | Cannot be prescribed via telemedicine under any circumstances |
Digital prescriptions are signed digitally or cryptographically stamped by the issuing RMP. Prescriptions can be transmitted to independent pharmacies for fulfillment through QwikPharm or ONDC integrations, subject to pharmacy stock availability and drug license verification.
8. Technology Latency, Dropouts & Connectivity
Telemedicine depends upon commercial telecommunication networks, cellular data providers, and internet service providers beyond the control of QwikPro. We are not liable for consultation failures, dropped audio, video lag, or interruptions resulting from weak patient bandwidth or general ISP outages.
In the event of an abrupt technical disconnect during a consultation, the platform provides automated reconnection protocols. If reconnection cannot be established within a reasonable window, the session may be rescheduled according to our Refund & Cancellation Policy.
9. Telemedicine Consent & Privacy Protocol
By clicking to begin a virtual consultation, you signify your explicit informed consent to engage in a remote telemedicine interaction. You acknowledge that you understand its modalities, benefits, and inherent limitations as outlined herein.
Recording Prohibition: Neither the patient nor the healthcare professional may covertly record, videotape, screenshot, or distribute audio/video consultations without express prior written consent from all parties involved. Unauthorized recording or public dissemination constitutes a severe violation of patient privacy and medical confidentiality laws.
10. Limitation of Liability for Clinical Outcomes
QWIKPRO PAYMENTS PRIVATE LIMITED expressly disclaims any and all liability for:
- Any clinical misdiagnosis, failure to diagnose, therapeutic error, incorrect dosage, adverse drug reaction, or medical malpractice committed by an independent RMP or clinic.
- Any adverse health outcome resulting from the patient's failure to provide accurate medical information or failure to follow the RMP's explicit instructions (including advice to visit a hospital in person).
- Dispensation errors, counterfeit products, or delivery delays originating from third-party pharmacies.
11. Feedback, Inquiries & Medical Ethics Routing
If you experience platform connectivity errors, video consultation transmission failures, or appointment scheduling discrepancies, please contact our Level-1 Customer Support Desk at [email protected]. Unresolved operational complaints may be escalated pursuant to our Grievance Redressal Policy.
Important Distinction — Clinical & Professional Misconduct: QwikPro is solely a technology intermediary and does not practice medicine or supervise clinical discretion. For complaints regarding clinical decisions, medical diagnosis, prescription appropriateness, or alleged professional misconduct by an independent practitioner, complaints must be submitted directly to the respective State Medical Council or the Ethics and Medical Registration Board (EMRB) under the National Medical Commission, as QwikPro holds no regulatory or disciplinary jurisdiction over licensed physicians.
